But again, as I've been saying these are simply more abuse tactics. We must remember. Cassie is not on trial. Her past is not on trial. Diddy is on trial. Diddy is accused of trafficking rape, physical abuse, surveillance, and more.

The defense is trying to distract the jury by slutshaming.

Even with these exceptions the defense would have had to file motions and go through hearings. they cant just blurt things out.

The exceptions to this are narrow.
- if someone else might be responsible for the physical evidence
- if the past behaviour is directly with the accused and relevant to proving consent
- if excluding it would violate the accused's constitutional rights.

The rule exists to stop exactly what Diddys defense is trying to do : attempts to undermine a victims credibility or imply consent by dragging their sexual history into court. You can't just say "she had a past" and expect that to justify abuse.

The Rape Shield law restricts what can be said about a victims prior sexual behaviour in cases involving sexual assault or misconduct.

The defense wants to create a narrative around Cassies past sexual behaviour because jealousy is a key element in their case. The problem with this is that it is a violation of the Federal Rule of Evidence 412 (also known as the rape shield law)

Okay before Day 4 begins lets talk about what happened yesterday in court before things wrapped. There was a heated exchange between the judge, prosecutors and Diddys defense team.

Stay alert. This trial will be filled with misdirection, but the core truth is simple: coercion is not consent. Abuse is not sex. Violence cannot be separated from the dynamics it touches.

Diddy’s team is trying to create a neat divide between the violence and the "lifestyle" as if those two things existed in separate rooms, never interacting. They didn’t.

I speak as an expert on intimate partner violence, a polyamorous person and a former swinger. Abuse thrives in silence and confusion. And it especially thrives when people don’t understand non monogamy or what coercion is and how it works.

But abuse makes real consent impossible. His violence didn’t exist outside of those dynamics, it defined them.

This attempt to sanitize violence by wrapping it in the language of non-monogamy is calculated. It’s meant to confuse the public, discredit survivors and exploit common misunderstandings about non monogamy.

You cannot consent to swinging (or any kind of non monogmay) if you:
- Don’t understand what it is
- Are high
- Are being threatened
- Are afraid of what will happen if you say no
That’s not consent. That’s coercion.

And for those unfamiliar swinging is a form of non-monogamy where people (often couples) engage in sexual activities with others, either together or separately. It requires clear communication, mutual agreement, and enthusiastic consent from all parties involved.

Consent is permission or agreement, but it must be:
- Fully informed
- ongoing
- Freely given
- & sober
If someone is under the influence, manipulated, terrified, or misled, they cannot consent.

This defense hinges on the public’s confusion about what consent actually means and their lack of understanding around non-monogamy. So let’s get a few things clear.

Based on what’s been reported, Diddy’s legal team isn’t denying the violence. Instead, they’re framing the trafficking and coercion claims as misunderstandings, claiming he was simply part of a consensual non-monogamous arrangement.

Which is not only dishonest but dangerous
