On Lawfare Daily, @klonick.bsky.social interviewed @ronanfarrow.bsky.social and Andrew Marantz about their @newyorker.com article on Sam Altman, the products he's building at OpenAI, and how he's selling them to investors and the public, and also to regulators and world leaders. youtu.be/O2GNrY63_2c

Great write up by @profrothman.bsky.social on what the call for new regulation around the Grammarly suit misses about the right of publicity.

These laws are already there and applicable to Gen AI! We need to enforce them!

Deeply relevant as we consider the hastily constructed NOFAKES Act.

Was awesome to present at @yaleisp.bsky.social today and kind of amazing to realize yesterday that my twin brother Dave would be on a panel at Thurmond Arnold across campus at the same time. That has to be a first, right?

@dachte.bsky.social FWIW, i address browser extensions like this but it got cut in editing.

These extensions work but the fact that only <0.1% of elite users can use a technological solutionism to get around technological regulation really speaks to how thoroughly this regulation has failed.

Constitutional lawyer here. I don't think it would violate the Constitution for the VP/Cabinet to invoke the 25th Amendment, but the intended constitutional remedy for this behavior is impeachment & removal. The fact that that remedy is politically impossible is a scandal and a crisis.

I think about this a lot. Beyond the policy harms, what’s the aggregate cost of millions of people devoting daily brain bandwidth to this criminal lunatic?

OpenAI Closing Its One-Stop AI Slop Shop Sora Is a Cautionary Tale There are lessons to be learned from Sora's downfall for the technology sector and its multitrillion-dollar AI behemoths, write Sarah Barrington and Hany Farid.

Why did OpenAI shut down Sora, and what does it mean for the future? For forensic researchers battling disinformation, it's both a relief and a stark cautionary tale for an industry moving too fast, write Sarah Barrington and Hany Farid. There are lessons for platforms and policymakers, they say.

The State Department’s X Directive and the End of Platform Independence A cable endorsing a social media platform by name as a tool of U.S. diplomacy and  military psychological operations would have been unthinkable—until recently.

My latest for @lawfaremedia.org on how Marco Rubio's open instruction to use X for U.S. propaganda and diplomacy is the latest high water mark in government cooptation of private platforms.
