While it's disturbing that the DOJ would rely upon claims discredited 5.5 years ago to make these demands, but it also shows DOJ recognizes they've got nothing, and they're running out of options for interference. 3 months ago - a warrant. 1 month ago - a subpoena. Now, a strongly worded letter.
I am 100% confident that, despite what the feds say or try, they will fail to undermine our elections. Voters will find that our elections are as safe, convenient, and secure as they've ever been, thanks to the states, and I am certain they will find the voting process to be easy and satisfying!
This is a good piece about attempted federal interference in our elections, but it's important to note that the guardrails that protect our elections are almost ENTIRELY at the state/local level, and are holding, thanks to courts, and especially, the election officials who give us all our voice.
How rare is noncitizen voting? Extremely. CEIR reviewed an Iowa audit that flagged only 0.01% of 2024 ballots as potentially cast by noncitizens. Rare but genuine fraud cases are referred to prosecutors — showing our systems work as they should.

There are other cases filed elsewhere, including a challenge to the EO filed by 24 states in Massachusetts.
The cases challenging last week's EO restricting mail voting filed in DC have been consolidated with Judge Kollar-Kotelly (who blocked Trump's first elections EO). She has ordered parties to begin filing injunction papers this week, and appears to be moving quickly to consider the challenge.
“We still have no idea where this data is stored, how it’s protected, or who has access to it. This data is incredibly sensitive. If someone has any of these sensitive data points on any of us, they can wreck us financially. This is why the states protect this data, and they do a good job of it.”
As we knew would happen, this mail voting EO has already, in >72 hrs, been challenged in 3 different lawsuits. The latest is this complaint, filed by 24 states. As I said, the EO is unconstitutional and illegal on its face. An easy win vs. the administration.

In suit seeking return of 2020 election records, Fulton County requested info from DOJ regarding the timing of events leading up to the search warrant.
DOJ says that info is privileged.
But Civil Rights Division chief Harmeet Dhillon previously discussed the timeline in a media interview:
President Trump signed an executive order requiring DHS to create a federal list of U.S. citizens and directing the Postal Service to only send mail ballots to voters on the federal list.

He says the same thing about mail voting without an excuse. In both cases, either knowingly or unknowingly, he's very wrong.
As the president demands documentary proof of citizenship to vote, it shouldn’t be lost that his lawyers today are arguing that the a birth certificate proving you were born in the US should be worthless for proving you’re a citizen. How will we all prove citizenship if he wins this argument?
I've now had a chance to review this purported EO, and it will definitely be blocked in its entirety as soon as the lawyers can get to court. The Framers made sure the President did not have the power to create a national voting list, or dictate to states how they run elections.
Some may freak out about this, but honestly, this is hilarious. It's clearly unconstitutional, will be blocked immediately, and the only thing it will accomplish is to make liberal lawyers wealthier. He might as well sign an EO banning gravity.
