The government is arguing that the downward variance in Jalloh's sentencing (from 240 months to 132) gives reason for caution. Further down in the government's supplemental brief, the prosecutor mentions that Davis is relying on many of the same arguments, although it isn't a perfect match.

The government's sentencing memorandum lays out in great detail Davis' extensive planning, such as ways to procure weapons, ammunition, and explosives. But here's the catch: the court continued Davis' sentencing and asked for the maximum penalty after Mohamed Jalloh's attack at ODU on April 10, 2026

Interesting case out of Michigan where the government is asking for the top-end of the sentencing guidelines (168 months) for Mack Davis, who plotted to carry out a mass shooting inspired by Juraj Krajčík, who shot and killed two outside of a gay bar in Bratislava in October 2022.
