I still think there's hope for trans rights on this court, but only if we change strategy. We need to say we fit into uncontroversial bits of the law. Personally, I think the 1st amendment is a much better target, the rights that matter flow from freedom of conscience and expression.
It's unwise to take an already controversial bit of the law and make it even more controversial. It's like saying that Trump has the right to deport everyone because it was ok to keep Japanese people in camps. More importantly, it asks the justices to decide what sex is, which they want to avoid.
Ok I know this take will be unpopular and will probably age like milk, but I think the court's latest trans decision isn't as crazy as it looks. Honestly, they're right, defending trans people on the basis of equal protection is a bad strategy.
this is good news, but until the supreme court confirms that trans people exist and are protected by the constitution I remain anxious. we are protected by the 1st amendment, in case you're wondering
