And I should say - this case was brought by @womenslawproject.bsky.social, Troutman Pepper, and me. We started working on it in 2017 and filed it in 2019.
Justice through civil litigation can take a looong time (too long). But victory is sweet nonetheless!
3) Even if there is no fundamental right, the Medicaid ban fails rational basis review because it is irrational to force someone to carry a pregnancy to term because they don't have the money to pay for an abortion.

Three big points in the incredible opinion:
1) The ban on Medicaid funding for abortion is sex discrimination. Thus, it's subject to a particular form of strict scrutiny. The state has no compelling interest and, even if it did, this ban is not the least restrictive means to those ends. /2

I’m on the left and involved in a lot of left spaces. The only time I hear “justice involved population” is when Andy Beshear complains about the term.
So wait, you’re telling me the Justices react differently to Presidential power based on whether they like the President politically?!? No way!!

We have had many conversations about this possibility in our household. So upsetting it's found to be the case.
I mean, those are exceptions to all doctrines, right?
But obviously I missed the footnote to that opinion that it only applies when the disagreement is with DEMOCRATIC policies, not when it's with REPUBLICAN policies. Silly me.
I seem to recall some Supreme Court precedent saying you can't cancel contracts with a religious entity because of disagreement with religious principles. Something that like Schmulton v. Schmity of Schmiladelphia.
