I read your article. You called them a para military force. But I would commend to your attention to the analysis from Mitchell v Henderson

(I mean, realistically this is a fifth amendment due process issue)

It’s a fifth amendment issue, because we aren’t dealing with actual soldiers

Thank you for coming to my TED talk

It’s actually a fifth amendment issue. ICE isn’t the military.

My conspiracy theory: the ballroom is a cover story.

The east wing actually covers the emergency operations center (bunker) and it needs to be redone to resist modern bunker buster weaponry and it’s likely being expanded in the process.

So a 3A violation should be enforceable through state trespass law

The problem with Bivens is that it established a federal tort rather than recognising that 4A enshrined immunity from state tort claims only if you had a warrant. That’s the function of a warrant. Confected federal immunity wasn’t something the founders intended.

It’s always 3A time. The most successful constitutional amendment we’ve had.

There really needs to be a way to get smackdowns on judges who say the stupidest things but it turns out it’s not prejudicial for you because you win on other grounds so there’s no appeal
