I’d say so. It shows where you were and I think the damage and its location fully supports that too.

Go up because that is the trend anyway, and a non fault accident can still statistically mean you’re potentially at a higher risk of an accident. Obviously even if it’s still an open claim you can shop around, telling the quote it’s a fault claim because it’s open and you might get a better price.

It can be a case of 50/50 but the fact there is a witness is great. The insurer could even have the damage inspected and possibly use that to identify the direction of travel etc. Until the claim is settled - this means your insurer recovers costs from the other party it’s considered as a fault

Whether he accepts liability at the scene or not it will come down to the insurers to sort it out. I think the impact is quite telling (I work in insurance), so make sure to tell your insurer everything and they should sort it out between them. Let them know if any CCTV in the area too.
