The Roxbury town council (unanimously Republican) opposed the project in January and joined the state's lawsuit. After New Hampshire's governor met with DHS Secretary Noem, the feds dropped a similar project there. NJ Gov. Mikie Sherrill sent a comparable letter, yet DHS moved forward anyway.

On Friday, NJ and Roxbury Township sued DHS to block the facility. The lawsuit argues the project violates federal environmental laws, would overwhelm local infrastructure, and send sewage overflows into the Musconetcong River, a federally protected drinking water source for 14.2 million people.

The warehouse currently has FOUR toilets. New Jersey jail standards for a facility holding 1,500 people would require at least 125 toilets, 125 wash basins, and 94 showers. DHS didn't consult with the state or town before buying it.
