Also this is a reminder of the Labor Secretary that resigned in Trump 1.0: Secretary Acosta for his role in the #Epstein sweetheart deal with all the secret co-defendants. 👀⚖️👇🏾 www.npr.org/2019/07/12/7....
The Volokh Conspiracy Mostly law professors | Sometimes contrarian | Often libertarian | Always independent About The Volokh Conspiracy SUPREME COURT Court Leaks and Attorney-Journalists The professional-ethics implications of making court confidences public. STEPHEN E. SACHS | 4.20.2026 4:11 PM The recent leak of internal Supreme Court memoranda to the New York Times, discussed earlier by Jonathan Adler and Josh Blackman—as well as by Will Baude and Jack Goldsmith elsewhere—was plainly a serious violation of the Court's confidentiality obligations. But it may also reflect serious legal-ethics violations by one of the Times article's coauthors, Adam Liptak, whom I understand to be a licensed attorney in New York and subject to that state's Rules of Professional Conduct.
This is some of the funniest shit the legal academy has ever blogged. 2000 words very seriously explaining why Adam Liptak, who hasn't practiced law in 25 years, should be disbarred because of the NYT's reporting on the Supreme Court memos. Man what are you talking about. reason.com/volokh/2026/...
This is not consistent with First Amendment law. At all!! Strong 1A protections apply when lawyers engage in public discourse. (Even when they don't, see Chiles v Salazar!)
Plenty of criticism on the right of the #SCOTUS leaker and the Times’s reporting, but has anyone actually responded to the argument that Roberts’s assessment of “irreparable harm” and his refusal to balance the equities is completely inconsistent with his subsequent behavior in all the Trump cases?
Looks like the prosecutors couldn’t make it stand up in court
Juries in California and New Mexico held tech platforms accountable for the harmful impacts of their design and business practices. Jennie DeSerio and Lori Schott, founding parents of ParentsRISE!, urge Congress to do the same and pass laws that truly protect kids.
TL;DR: The Trump family's cryptocurrency activities are under scrutiny as concerns about crypto enforcement diminish, highlighting ongoing issues within the regulatory landscape.
Could this be the 1st time EU funding is suspended on rule of law related grounds, with EU condition to unlock the suspended amount compliance with non-binding recommendations of a non-EU body?

Drinking a manhattan in the Delta Lounge en route to Lexington, where I’ll be teaching my last week of classes at UK Law & packing up my office, before joining the faculty of Tulane Law. 🙏
Doing a little research and I came across a bunch of articles discussing submitting appellate briefs on CD-ROM. That became ancient history fast.
To be fair, Kash has been in the "file bogus SLAPP suits" game for a while now. www.techdirt.com/2019/11/21/f...
FBI Director Kash Patel filed a lawsuit against The Atlantic over a story it published Friday that alleged he drinks to excess and has had unexplained absences at the bureau.
Patel thinks Discovery will reveal who is talking, but I trust The Atlantic. storage.courtlistener.com/recap/gov.us...
I don’t think this even counts as an Unpopular Opinion, but court packing is not happening in my lifetime (prediction) so there’s going to be intense pressure from Dem voters for the next Dem president to defy SCOTUS. If the Dem POTUS does it, it was very likely have to be an even more in your …
NOW there's a "wake up call" that county sheriffs will use their investigatory powers to disrupt elections despite me writing about this since 2021.

Discovery in the Kash Patel--I'm not as say as you drunk I am-- defamation suit will be lit. :)
50% chance I dream tonight that I need to deliver my oral argument next week in Armenian (which I speak, but not with legal words!)
Had a legal-legal call with a customer, and near the end he goes "Do you have a background in computer science??"
Turns out he also has a background in computer science 😄
Somewhere out there, in a law firm office far, far away, an associate on the defense team for John Brennan just started updating the exhibit list for his draft selective or vindictive prosecution motion

“Every program that carries the president’s name sends a message that the benefits of government flow from him personally. Not from Congress, or the Constitution, or our collective project of self-governance.”
Say what you will about the worst members of the Roberts Court, but they all make sure their wives are in on the grift.
Jane Roberts, Martha Alito and Ginni Thomas are equal partners with their husbands in the grand project of destroying the United States and enriching themselves in the process.
If anyone can explain how it is the court denied cert. in this case after recently deciding the merits-adjacent Mirabelli case on the shadow docket in favor of challengers, I'm all ears...

It seems to me that any government official who sues for defamation should be required to pay attorneys' fees x 3 plus costs if they drop the case, and x 5 if they lose.
Given that the rest of us cannot (for all intents and purposes) sure federal employees who defame us, there should be a rule announced that applies the same type of official act analysis to determine whether federal employees can sue private parties for defamation.
So many more folks are gonna learn about his drinking problem because of this lawsuit.
