That placed it on behalf of a client. Outside of the CFTC you would need a leak from the broker or platform to take place. Unfortunately regulatory filings like a 13F won’t list short term trades which this almost certainty was. The person or group that made this trade likely sold out the same day.
It is challenging to get the end identity of the individual or hedge fund that made the trade. 3rd parties can see what exchanges/platforms the trades took place on which can help narrow the universe but the only 3rd party that truly knows right now is the exchange that took the trade or the broker
The question is whether they will actually investigate and do anything about it but the activity reeks of having advance knowledge. The CFTC would be able to see both sides of the trade. Punishment typically involve fines, disgorgement of profits, and possible license sanctions or forfeitures. 2/2
In this case it is going to fall under the jurisdiction of the CFTC rather than SEC as the trading was done in the options market. They (and the SEC) do highlight and review suspicious trades and the options volume in both the S&P and Oil futures yesterday morning would certainly trigger a flag. 1/2
