And hopefully she can and has done so. Certainly the press attention hasn’t hurt. But ICE has to release their own hold. A state judge cannot do that. Maybe we focus some attention on the Leon County deputies who assumed he was undocumented and arrested him, which started this whole shitshow.
It was a state judge, who has no power when there is an ICE hold. He was released on the state charge and is now in the custody of ICE. Who SHOULD realize within 48 hours that he’s a citizen and release the hold, but who knows these days?
There won’t be a trial. There was no PC for the arrest because he wasn’t actually undocumented. In theory, the State Attorney could still charge him, but they won’t, because he’s not undocumented. But none of that affects an ICE hold, and the state judge has no power over that.
Florida lawyer here - he can be ordered released on the state charge and still incarcerated on the ICE hold. That doesn’t always show up on the docket.
So what SHOULD happen is ICE realizes within 48 hours that he's a US citizen and releases their hold. The criminal charge was dropped. What will ACTUALLY happen? Who the F knows anymore?
But they kicked it back to the District Court, correct? Who can presumably impose a new deadline? I realize that gives them a chance to appeal again, but the District Court took it very seriously and presumably will do so again. With a VERY short deadline for compliance.
