It's the same trick Sex Matters used in "free speech." When they got their "Gender Critical Beliefs" ruled to be a protected characteristic by the courts, their discriminatory anti-human, anti-reality pseudoscientific viewpoint was legally elevated to be equal to a trans person's right to live.
The tell: If trans/gender diverse people are simply "expressing" themselves, why does fire never interpret a trans person's right to exist as a threatened aspect of "free speech?" Why are they not fighting drag bans as a violation of free speech? Social transition laws? Pride crossings? Book bans?
FIRE and orgs like them assist in the social murder of gender diverse people by equating their very existence with "expression" which can be policed. Then they equal that to one's liberty with the "right" to spew lies and bigotry. When academics saw through this, they became violently reactive.
