Johansson: Two Hungarian ministers have promised the government would comply with EU asylum ruling
The EU Home Affairs Commissioner told Szabad Európa that the Hungarian government was working on preparing the implementation of the asylum package.
Note that the prior CJEU judgment concludes that a ban on a category of people applying for asylum breaches not only *EU legislation* but also the *EU Charter of Fundamental Rights* - ie the primary law of the EU. So an EU Council emergency law purporting to let Poland adopt a ban would be invalid.
At first sight, an obvious breach of EU law - unless this simply amounts to a delay in processing asylum applications, or the idea is to request the EU Council to adopt an emergency asylum law allowing Poland to do this. The asylum pact 'crisis' law does not apply yet, and does not provide for this
In short order, Hungary has challenged military support for Ukraine and the European Media Freedom Act, while the Le Pen party has challenged the new EU asylum pact. Populist RW parties/govts increasingly becoming plaintiffs in the EU courts, not only defendants.
