It would amount to government control of the AI sector. It would also violate the First Amendment rights of the companies and individuals who seek to ensure that these new forms of intelligence are safe for humanity.

The DPA provides no authority for DOD to require a company to violate its own engineering and safety policies. It requires only that a company prioritize DOD contracts over others. DOD seeks to dictate the fundamental safety decisions of a private company.

The supply chain risk designation of Anthropic, after it insisted on guardrails for DOD’s use of its systems, is unlawful. DOD had threatened to use the Defense Production Act to require the firm to give DOD the capability DOD wants. This has received less attention. The DPA gives no such authority.

Congress’s only meaningful war power is the power of the purse, which is never used.

Democrat posturing about an Iran “War Powers Resolution” is theatrics. It is not a law because it would be vetoed, so it’s a nullity. And the labeling confuses this with the resolution required under the War Powers Act to authorize hostilities beyond 60 days. The WPA is a dead letter.
