An FOI request reveals that the EHRC is not planning to publish a report on its public consultation until AFTER its new Code of Practice has gone all the way through Parliament, and is a “done deal”. But how can they carry out this important Parliamentary duty without any insight into the public’s 50,000+ submissions to the EHRC’s obligatory consultation?
MPs will have no idea whether the EHRC integrated any of those stakeholder responses into its finalised Code – or ignored them entirely. Luckily, TransActual and TACC anticipated exactly this problem. They asked individuals and organisations to share their EHRC public consultation submissions with them. The result was a massive 10-volume dossier, which we have delivered directly to the heart of Government. Govt have total control over what happens next. They can require the EHRC produce a code that is compliant with the Human Rights Act and the public sector equality duty. They also have a range of legislative options open. If they choose not to act, they are responsible for every bit of harm.

The draft is cruel; there is no evidence it will better protect women, cis or trans; it breaches Labour's manifesto commitment to trans people; it is unenforceable; encourages vigilanteism; and it is clearly inconsistent with the UK's obligations under the ECHR. We will challenge it in court. 2/2
We are aware of the EHRC's briefing to The Times about its draft statutory guidance. The draft is inconsistent with the Supreme Court's explicit assurance (from para 248) that its "interpretation would not be disadvantageous to or remove protection from trans people with or without a GRC." 1/2

It has a duty to each and every individual that it serves and must respect their human rights. At the same time, it has a wider social duty to promote equality through the services it provides and to pay particular attention to groups or sections of society where improvements in health and life expectancy are not keeping pace with the rest of the population.
This directive is in absolute contraindication to the very first point of the NHS constitution.
