I hope @ukparliament.parliament.uk would act to amend this decision.

The Court didn't mention anywhere in its decision the Interpretation Act of 1978, which would allow for an interpretation of the Equality Act that would better protect trans people >

The Court was reassured in its conclusion by anti-trans sentiment held by some lesbian groups >

The Court further held that it an find no "good reason" to hold that the legislature intended to have sex protections applied to the "complex" reality of trans people >

The Court read various instances in which references to sex, women, and men, are mentioned in the Equality Act, and in other Acts, holding that the ordinary meaning of sex is biological, and that only in interpreting sex in this way the various sections make sense >

The UK Supreme Court released its judgment in For Women Scotland Ltd v The Scottish Ministers, and it has considerable implications for trans individuals and rights, as the Court held that 'sex' under the Equality Act can only be understood as 'biological sex' >

Also, as we were leaving the official dinner, we walked past Tilda Swinton. Was tempted to give her a copy of the book, but didn't want to interrupt. So Tilda, if you want a book on why states should compensate civilians for wrongs in war, let me know where to send it @christianhodell.bsky.social

Myths and misconceptions in extraterritorial torts | University of Toronto Law Journal States’ ability to impose liability for extraterritorial torts is often structured to avoid an illegitimate assertion of authority by one state over another. However, the resulting liability regimes are inconsistent and difficult to justify. In this article, I argue that limitations of liability in this context have been based on misconceptions about abuse of power. I employ instrumental and rights-based approaches to states’ authority to demarcate a coherent framework for states’ liability for extraterritorial torts. I show that courts can impose liability on their own state and officials for extraterritorial torts as authority is not exerted over a foreign state. Liability can also be imposed on foreign states for their extraterritorial torts through consent, a sufficient jurisdictional connection to the tort, or the establishment of universal jurisdiction by a breach of jus cogens norms. Lastly, I assert that punitive damages are generally an illegitimate form of exerting authority.

'Myths and misconceptions in extraterritorial torts' is now out w/ University of Toronto Law Journal utppublishing.com/doi/abs/10.3.... I offer an account of legitimate imposition of tort liability on states for extraterritorial torts, while arguing that punitive damages are generally illegitimate.

🚨 New Article Alert! 🚨

Revisiting the age old debate: is software a product, a service, or just a glitch in the matrix? In this ILJ piece I dive into a 50-state survey, post-3rd Rstmt case law, & even throw in EU law analysis and Platonic idealism for good measure.
