South Dakota has passed a new law allowing voters to challenge the citizenship of other voters ahead of elections. Supporters say it strengthens election trust; critics warn it could lead to profiling and added barriers for eligible voters.

When you consider all of this, the purpose becomes clear: at best, this law invites voter intimidation. At worst, it legitimizes racism.
Brown and Black U.S. Citizens already fear being targeted by immigration enforcement. Non-citizens are afraid to leave their homes for fear of deportation. And falsely claiming U.S. citizenship is itself grounds for deportation.
But what “fact” could justify questioning someone’s citizenship? The answer is obvious: race, national origin, or an accent.
And the premise behind this law—that non-citizens are voting—is especially dangerous right now.
Message from SDVFP CEO Taneeza Islam:
“How do you know I am a U.S. citizen?”
In South Dakota, anyone can now challenge your citizenship with a county auditor or the Secretary of State in an attempt to stop you from voting. The challenge must supposedly be based on “facts.”
