It was weird because the fine demanded payment within 30 days, but on appeal the government is claiming that it isn’t enforceable unless and until they sue the carriers - at which time they get the jury trial. I’m thinking WTF? Why don’t they just refer it to DOJ and not send the fine letter?

I knew nothing about the case until listening to oral arguments. Apparently, the FCC fined AT&T and Verizon 100s of millions of dollars, but now says it’s not binding unless and until DOJ sues to enforce it.

FCC v. AT&T and Verizon v. FCC oral arguments sounds like the FCC is going to lose. Kavanaugh has said he thinks the companies will win on the law. Other justices are asking hard questions, but they seem to be looking for any way that the government could be right just in case.
