If that was acknowledged (and dealt with similarly, instead of the broad immunity), then many of these cases might not exist, in the sense that the officers would likely maintain a similar insurance coverage to surgeons or drivers that would be searching to settle such cases at the trial level.
And, would hope, also means having capability of developing said talent, and developing it well. Which may be another (yet related) issue.
