How is it proposed a judge can be satisfied on this aspect? To what extent will there be a proper enquiry into it? Will the judge have discretion on these decisions or are they simply there to rubber stamp the process once the medical evidence shows that P has capacity and approaching end of life?

I can’t see how a judge is going to be able to examine and be satisfied about that without a full and detailed hearing including evidence from the patient.

Seems to me that as drafted the court is merely a rubber stamp process if criteria met. Pointless in those circumstances and something of an abuse of the HIgh Court. I sense it’s there simply to provide some reassurance although in reality it does not.

I remember both Ernest and Margaret well. I became a door tenant at SJB when Ernest, Margaret de Haas and husband all took appointments and relatively new silk and my good buddy, Anthony was the only silk in town. Many cases done on your patch and good friendships made. Good times.
