By statute, the Federal Communications Commission (FCC) is an independent five-member
regulatory agency whose collective decisions are subject to review by the Federal Appellate
Courts. Republican and Democratic Commissions have followed this structure and procedure for
decades.
You and your predecessor have turned the Commission into an authoritarian agency in which
decisions reflect the views of one person—the Chairman—rather than the collective input of all
three active commissioners. These decisions are issued at the direction of the Chairman through
one of the agency's bureaus, whose decisions are not subject to judicial review. The final step in
this unlawful transformation is for the Chairman to refuse to grant an Application for Review of a
bureau decision by the full Commission, thereby completely avoiding the obligation to defend
the Chairman’s unilateral decision before an appellate court. This is not the decision-making
structure set forth in the Commission’s enabling statute. And it departs radically from decades of
Commission precedent.
The illegality of your authoritarian management of the FCC is exacerbated by the fact that
President Trump has asserted unprecedented executive branch control over this agency. The FCC
is an independent regulatory agency, whose commissioners can only be removed for cause.1 But
on February 18, 2025, President Trump issued an unprecedented Executive Order 14215,
“Ensuring Accountability for All Agencies.”2 In this order, President Trump purports to assert
control over all administrative agencies, including what the order calls “so-called independent
agencies.”
