I live in the EU, I think you’ll find my online rights are very much backed by the GDPR.
Coming back to the comparison with open source code; when a code base that’s available on the internet doesn’t have an explicit license, it is assumed it’s All Rights Reserved. The same thing applies here. No explicit consent, no right to export my data.
I certainly do have a right to say what can be done with my data.
Collecting data from users without their consent is a practice of centralised networks and predatory corporations. I thought Bsky was supposed to be better than that, but oh well, looks like that didn’t last

I’ll say it again, having open data does not mean having a license to use it for anything.
The same thing applies to open source code, for instance. It’s open to access, anyone can read, modify it, download it for private use. But there are still licenses that regulate how you can use it, commercially or not, for private use or not.
Open protocols have terms of service. There are laws surrounding what you can and cannot do with public data. This argument is nonsensical.
You should not expect people to know about every dangerous project you conjure. Making it opt out is exposing people to an unwanted audience, which they explicitly chose to break from by being on the Fediverse.
A Fedi/Bsky bridge that isn’t opt-in is NOT “using ActivityPub”. It’s scraping data from ActivityPub and republishing it into a for-profit network with lower moderation standards.
I’m not wholly opposed to it, as long as it is OPT-IN.
