Seeing some commentary about the perils of turning vote-counting into election-night cable-news drama. So let me just point out that I wrote about this in Nov 2024¹ … and in May 2024² and in Dec 2022³ and in March 2018.⁴

Indeed. Every part of it was a choice.
For sure, the folks lying about how this all works are primarily to blame.
But the most natural implication of the graph while ballot counting is still underway is a trendline. And that’s emphatically not the right interpretation in this context.
I’m not sure that last point is correct. It’s my understanding that you can (still) get a postmark at the counter if you ask for one.
But whatever happens at SCOTUS, mailing ballots early is still best practice.
The impact of a SCOTUS decision (wrongly) interpreting federal statutes to require ballots to be in by election day are going to affect a lot more states than most people think.
There is, at present, no statutory servicemembers exception for the date of return.
I'll confess I don't have the stats on this. But I'd bet that the biggest population of people who return ballots after election day are servicemembers.
And if - against all interpretive logic - current federal statutes mean ballots have to be in by election day, that means for everyone.

The presents are all already finalized once you start unwrapping. Nobody's "ahead" or "behind" or "mounting a comeback" as you unwrap. The presents are what they are, they're all going to get distributed, and the order you unwrap them isn't meaningful.

And WILDLY misleading for everybody else. Given differences in how ballots are counted, nobody should expect a pattern of ballots counted earlier to fit a pattern of ballots counted later! It neither indicates foul play nor a surge.

There has been an attempt to get the DNC to do this since at least 2009 (and probably well before), and it has never been even slightly interested. Would be very interesting indeed if it finally decided on a strategy that incorporated investment.
