For a host of reasons, there are a large number of non-citizens who entered the country legally, but who lack permanent immigration status (two common examples are individuals who overstayed their visas, or who had a form of temporary protected status that subsequently expired or was rescinded).

It is not a crime to be undocumented. Although federal law does criminalize unlawful entry by a non-citizen, it does not criminalize unlawful presence.
