I do think it is notable that our greatest, most effective Presidents have been openly skeptical of the Supreme Court’s authority, and the Presidents who leaned on it most were among our worst.
This may be mainly the kind of nerd that I am but IMO Congress should engage in more explicit constitutional interpretation through statutes, like literally spelling out how some clause will be understood. And openly contradicting judicial precedent where necessary

The law provides for the senior most available associate justice to act as Chief Justice in the CJ’s absence. So long as at least one anti dictatorship justice avoids being stuck in DC, a trial can be held.
I have seen someone else in this discussion point out the issue that the Constitution makes no provision for the impeachment trial of a President when the Chief Justice is unavailable to preside, as Roberts might be either because he sides with Trump or because Trump detains him.

It seems like, if we get dueling Congresses, the path of least resistance is the rump Dem Congress impeaching and removing Trump and his acolytes, forcing an immediate legitimacy crisis. Much less Constitutionally troublesome than forcing the (correct!) 14AS3 to just say he’s *no longer* President.

If they wish to remove a potential cause of dispute as to disability, they can impeach Roberts, Thomas, and Alito, leaving Sotomayor as the most senior remaining justice.
Assuming one of the liberal (or even less insane conservative) justices sees the writing on the wall and isn’t in DC on 1/3/27, the Senate takes a majority vote to recognize all the Vichy justices as disabled by their detainment by insurrectionaries, and invites the most senior democratic justice.

Congress can’t override a pocket veto. An unsigned, un-vetoed bill automatically becomes law after ten business days, unless it’s at the end of a Congressional session, at which point it is automatically vetoed without appeal. Congress can only act more quickly if the President returns the bill.

If Congress splits into a valid Congress-in-exile and an invalid pretender’s Congress, Republicans literally cannot prevent the valid Senate from purporting to remove Republican officials while still maintaining the premise of a quorum in the invalid Senate.
To also have a quorum to do regular business in the fake Senate, they would need to have 50 Senators, totaling 77 Senators overall.
“Ah, but they’ll send more pretenders.” Except even if Republicans won literally every Senate seat up for election in November, they’d only have 65 Senators.
Republicans can’t even send enough Senators to the Congress-in-exile to cover their bases by making sure that the CIE, even if recognized as legitimate, can’t remove Trump. For 53 Senators to be insufficient for removal, you need at least 80 present and voting. That requires 27 Republicans there.
