In February 1991, Nintendo filed suit in a Paraguayan trial court seeking cancellation of the two registrations. Although the Paraguayan Supreme Court recognized that the statute of limitations might be tolled by a bad faith registration, it held that the question of Precision's bad faith was not a constitutional issue within the Court's jurisdiction. Nintendo of America, Inc. V. Precision Trading Corp., No. 292 (Sept. 2, 1993). Accordingly, the Supreme Court dismissed the case, leaving Nintendo without any further legal recourse. As a result of the decisions of the Paraguayan courts, Nintendo cannot use its own trademark and trade name in Paraguay and, therefore, may be unable to conduct business in Paraguay. Nintendo's potential inability to do business in Paraguay is demonstrated by the fact that I.I.S.A. 2 has published a "Warning," asserting its exclusive right to use the NINTENDO trademark in Paraguay, and warning that I.I.S.A. will initiate legal action to seize and destroy any "counterfeit" merchandise bearing the NINTENDO trademark. See Exhibit 1 at p. 7 (the original Spanish version and an English translation of the "Warning"). Of course, all of Nintendo's authentic video game products, including those of Nintendo's Licensees, bear the NINTENDO trademark.

In Diddy Kong Racing DS, the message when connection is lost during Download Play is "LOST ALL CHILDREN". The cartridge is internally called a "parent" and the downloaded instances its "children". While this would make sense to the developers, it has the potential to confuse or scare players.
