Disgraceful. The Froid mechanic and community member taken by ICE (and who just had his felony immigration charge dropped) has now been disappeared out of the jail up in Cascade County

The agreement our ex sheriff signed w ICE might not even be valid. And we have no clue how much it's costing us financially (or what taxpayers will be on the hook for when someone rightfully sues over this)

The lack of communication for people caught up in this system is cruel to both families and the people detained.
It also makes it hard for people to get a lawyer.
It interferes with their due process.
ICE detention centers have been notorious for harsh conditions and ill treatment of detainees.
These transfers happen so quickly that itβs difficult for families and lawyers to track and communicate with people being transferred.
As of last year, people have been transferred mostly to the Cascade County Detention Center in Great Falls, where they are held for 2-5 days before being transferred to ICE detention facilities out of state.
The agreement allows the Detention Center to routinely place ICE holds on immigrants detained for misdemeanors. When people have paid their bond or are released pending trial (ie deemed eligible to be released) they are instead held for 48 hours to allow transfer to ICE custody.
Because of this agreement, last year 84 individuals were transferred from the Gallatin County Detention Center to ICE custody, many with only misdemeanor charges.
This is by far the most common path for ICE detention currently in Gallatin County.
Our former sheriff signed what's called a 287g agreement with ICE in 2020.

This agreement is probably invalid; we donβt know what it means for liability for our county, or for costs to taxpayers.
That sheriff has since moved on, so now we and our current county government have inherited this 287(g) agreement. None of us had the chance to weigh in on this or to make our voices heard.
