SCOTUS wrote in that decision that there are ā€œno limitsā€ on when Congress can implement the limitations of Section 3 of the 14th amendment. If I were in charge, I’d simply pass an acknowledgment that the impeachment articles of January 2021 were Congressional acknowledgment of his insurrection.

Troubleshooting some separation of powers language for the 30th amendment (28th is the ERA; 29th is enshrining the right to vote as inherent in citizenship and public funding of elections). If we make Section 3/14A self-executing, I think that could help.

In Trump v Anderson, the decision that claimed Congress needed to recognize the Section 3 disability for it to apply, the examples cited by the court DID NOT REQUIRE a majority of either chamber of Congress. But, it did say that Congress could apply it at any time with ā€œno limitsā€. Just saying.

I personally believe the route to freeing ourselves from Trump runs through at least three constitutional amendments: the adoption of the ERA (easy); a national popular vote for president (harder), and a brand new anti-corruption amendment, with publicly funded elections (near impossible).
