We reach these conclusions with great reluctance and dismay and even greater
restraint - only after another exhaustive analysis of another extensive record under well-developed legal standards, as Supreme Court precedent in these very cases instructs. We do not intrude lightly into a process ordinarily and properly reserved
for the Alabama Legislature, but forty years' worth of Supreme Court case law and forty years' worth of statutory instructions from Congress compel this result in this
case.
We emphasize that we remain deeply disturbed that the State purposefully enacted a map that the State readily admits does not provide the required remedy for the vote dilution that we clearly found. We also emphasize our concern about the
State's assertion that in response to any injunction we may issue, it is free to repeat its checkmate move. We are troubled by the State's view that even if we enter judgment for the Plaintiffs after a full trial, the State remains free to make the same
checkmate move yet again - and again, and again, and again.

We reject in the strongest possible terms the State's attempt to finish its
intentional decision to dilute minority votes with a veneer of regular legislative
process. On the rare occasion that federal law directs federal courts to intrude in a
process ordinarily reserved for state politics, there is nothing customary or
appropriate about a state legislature's deliberate decision to ignore, evade, and
strategically frustrate requirements spelled out in a court order.
This is not the first time the Alabama Legislature has purposefully refused to
satisfy a federal court order about redistricting even after the Supreme Court
affirmed that order. See generally Sims v. Baggett, 247 F. Supp. 96 (M.D. Ala. 1965)
(three-judge court: Rives, Thomas, and Johnson, JJ.) (per curiam). We hope it will
be the last time.

To be clear, this is a panel with two Trump appointees — Judges Manasco and Moorer — and one senior circuit judge, Judge Marcus, who was appointed to the district court by Reagan and appeals court by Clinton.

This is their striking, big-picture takeaway:

White House threatens to veto Senate measure nixing Trump’s global tariffs The Senate is expected to force a vote this week on the resolution.

We’re expecting a Senate vote later this week on a bipartisan resolution that could block Trump’s tariffs. Tell your senators to draw the line on executive overreach and end Trump’s bogus emergency.

During WWII, my family—American citizens—was imprisoned without due process under the Alien Enemies Act for their Japanese ancestry.

Now Trump has been using that same law to send people to a foreign prison in El Salvador.

The constitutional crisis is here. I won’t stay silent.

We used to spend $800 - 1200 a month from our business. Now we spend less than $50 with the balance moving to Costco.

Reporters need to press DHS/ICE about their policies and practices around arrests.

They need to ask about their internal protocols for identification and arrests.

Recall that DOJ has recently prosecuted people for impersonating their agents. Several people are serving long sentences for doing so.

You know the *only* reason he got out so fast was a reporter live posted about this for hours. And, a large amount of public pressure.

Every time someone gets grabbed, there has to be a robust public response immediately.

WILKINSON, Circuit Judge, with whom KING and THACKER, Circuit Judges, join:
Upon review of the government's motion, the court denies the motion for an
emergency stay pending appeal and for a writ of mandamus. The relief the government is
requesting is both extraordinary and premature. While we fully respect the Executive's
robust assertion of its Article II powers, we shall not micromanage the efforts of a fine
district judge attempting to implement the Supreme Court's recent decision.
