I unironically believe this. If you're in charge of deciding what is THE LAW, and you hold that position for life, you should have to give up all of other pursuits and dedicate yourself fully to doing nothing but that, without anything else to distract you or influence you.

What if The Pelican Brief was really about the shadow docket?
"Originalism" promises 2 things: restraining "judicial activism" & (though worded differently today) retaining the Constitution's original intent. By inventing a whole new way of operating on the fly, Robert's showed how phony both claims always were.
This is both
(1) some of the most important SCOTUS reporting ever, and
(2) far too generous to the Republican justices in framing of many pieces and omissions of Trump-era developments
it is, among other things, incredibly striking to see that roberts was so solicitous of the burden the clean power plan might put on fossil fuel executives, when, a decade later, he is indifferent to the way trump’s moves have thrown hundreds of thousands of lives into turmoil.
Most striking to me about these memos is the radically different assessment of the harm imposed by the president not being able to pursue his initiatives. Over the last 15 mos., that harm has in numerous cases been treated as almost per se serious and irreparable. Here, it gets no analysis at all.
This new NYT reporting on the birth of the shadow docket might also be coining a new term for another feature of SCOTUS practice: “vacation mode.“

without lionizing Leo XIV too much, i think people are brought up short by encountering someone in a position of authority who seems to have commitments to stable concepts of right and wrong that supersede class loyalty to other powerful people (which is largely the same as what Dan is saying)
