CONCLUSION

The Court finds the decision to proceed with the 15th Street Cycle Track Removal to be
arbitrary and capricious because the record does not reflect that the defendants examined the
relevant data and articulated a rational connection between the facts found and the choice made.
It further finds that the defendants’ invocation of the highway modernization categorical exclusion,
and their conclusion that the Removal Project would not have a significant impact on public health
and safety, to be arbitrary and capricious as well. Therefore, the decision to proceed with the
Removal Project as described in the March 31, 2026 NPS Decision Memorandum and the March
31, 2026 NPS and FHWA Categorial Exclusion documents, as well as in the February 23 NPS and
February 27 FHWA Categorical Exclusion documents to the extent they were not rescinded or
nullified but only elaborated upon on March 31, is hereby VACATED and REMANDED to the
National Park Service and the Federal Highway Administration. This means, as counsel for the
defendants acknowledged on the record at the hearing, that the decision is null and void, and the
Removal Project may not and will not proceed on April 23, 2026. Given the ruling in plaintiff’s
favor on the merits, plaintiff’s request for interim relief is denied as MOOT.

A protected bike lane between the sidewalk and a floating bus stop near 2000 Clarendon Blvd in Arlington, VA. The bike lane ramps up to meet the pedestrian crossing between the sidewalk and bus stop. There is a gutter on on the right side of the bike lane. At the beginning of the ramp, water is diverted from the gutter into a channel directly behind the curb. The channel is covered with metal panels. The channel continues behind the curb to the other side of the pedestrian crossing where water is directed back to the gutter in the bike lane.

When I saw that “solution”, I knew there would be problems. There should be a retrofit similar to the block to the south (2000 Clarendon) where the drainage is diverted behind the curb in a covered channel bypassing the ramp completely. Better drainage and safer for cyclists.

Did they fix the ped signals yet? Last Wednesday night I rode through and at the streets where cyclists are to follow the ped signals (Eads, Fern, mall garage) those signals never changed. So I had to run the “red” ped signal. The ped phase needs to be set to recall not pushbutton actuated.

When will these open? I tried to undock a bike at both Innovation Ctn S and Carta Way/Sayward Blvd but was unable to as all the docked bikes were giving the error message in the app: “Sorry this bike is outside the regulatory area”. Also my CaBi key did not work either.

Twenty years ago when I was studying for the PE exam, Arlington Central Library was open until 10pm! (Mon-Thurs). It was always quite busy up until closing. But budget cuts through the years have reduced hours. First to a 9pm close. Now 8pm.
