Just a heads up- even if the ban does go ahead (which it currently looks like it won’t) it wouldn’t apply retroactively- it would only apply to new posts, they can’t arrest you for something that was legal at the time when you did it!

There is no government amendment in lieu for amendment 261, that one passed as-is

265, as mentioned in my post, has been replaced with the government amendment in lieu, which says about a reasonable person believing that the video participants are over 18

RE: this- the House of Commons rejected the proposed amendments that potentially banned abdl content, so now it will return to the House of Lords for further debate.

Unfortunately the amendment that bans breathplay did pass, so when the bill gains royal assent, posting breathplay becomes illegal 😭

Section 67A | Criminal Justice and Immigration Act 2008
It will be illegal to share imagery of suffocation to anyone
who did not directly participate.
This means it will be illegal to share any breathplay photos
and videos to sites such as Telegram, Bluesky and X.

It will be illegal to possess imagery of suffocation, unless
you directly participated.
This means only you can keep a copy of your own
breathplay photos and videos, as long as you did
not cause non-consensual harm.

Breathplay Section 67A | Criminal Justice and Immigration Act 2008 It will be illegal to share imagery of suffocation to anyone who did not directly participate. This means it will be illegal to share any breathplay photos and videos to sites such as Telegram, Bluesky and X. It will be illegal to possess imagery of suffocation, unless you directly participated. This means only you can keep a copy of your own breathplay photos and videos, as long as you did not cause non-consensual harm.

person who is ‘implied to be a child’.
“Implied to be a child” is the literal wording in the
amendments, and as you can see the interpretation can
be broad!

The legal test will be whether the content would make a
reasonable person think it’s depicting or implying a child;
looking at how the image is described by you, any sounds,
the context, setting and appearance of anyone in the imagery.

Being dressed in a diaper and onesie and posting it clearly
as adult content is probably going to be okay, however the 
legal issues arise when you combine it with cribs, playrooms, 
childlike behaviour and captions like “I am a 1 year old baby” 
or “good little boy/girl”.

I have done a deeper dive into the proposed Crime and Policing Bill, and want to share my interpretations of potential changes to laws in the UK.

It will affect all breathplay-related content, along with those who identify as ABDL.
