If new evidence comes to light proving that you are actually innocent of the crime for which you are serving a sentence, the government should vacate your conviction and release you.

In this survey, 24% of judges reported having no formal policy about AI use in their chambers, and another 18% discourage its use without preventing it.

In those 42% of federal courtrooms, law clerks would seem to have an outsized role in deciding how AI contributes to published precedent.

For federal judges, I’m particularly curious how they’re supervising their law clerks’ AI use, if at all. Clerks are typically the first, if not the primary, opinion drafters.

In one sense, this is unsurprising. The largest legal research platforms push AI heavily and integrate it with their search functions in many ways.

But without clear guidance or consensus on how to use AI, this is the wild west with wide variety and lack of transparency in how it’s used.

In those ways it really brings back memories of Ken Griffey Jr.

I’ll be curious to see how attorneys (and courts) handle this going forward.
