In a legal brief made by either party attorneys do typically include the "application" section of an argument, where they show how a law has been applied in the past to support their argument for how it should be applied going forward.
I think you or your editor should not have called it a "rule". Yes it is a rule in a broad sense as laws are rules, but what they are trying to scrap is a LAW passed by Congress and signed by a President. You should emphasize that they are trying to scrap a LAW in the headline.
