I know direct infringement doesn't depend on knowledge. But choosing to do nothing upon notice is a volitional act. At least I would have no compunction arguing that it is. Not that I agree that "volition" is required either. If a registered work is copied, it's actionable unless it's not.
The DMCA safe harbor eliminates *direct* infringement claims if you comply with takedown procedures. I understand direct infringement is strict liability, but knowledge operates to take that infringement out of the DMCA safe harbor. I don't live and breath DMCA, but am I missing something here?
But once you have knowledge of the allegedly infringing copy and the copy remains on your server, that becomes direct infringement, no? If someone downloads it from your server, after you know it's there and you do nothing to take it off your server, you are a direct infringer. Cox doesn't apply.
