Para além disso, a própria lei concretiza limitações à prática de atos após a demissão dos Governos, em especial quando se trata da nomeação de titulares de certos cargos, como os cargos de direção superior da Administração Pública, dos institutos públicos ou empresas públicas

O âmbito dos seus poderes depende do requisito da necessidade, que tem dois fatores de referência: i) a urgência, i.e. o Governo deve atuar, sob pena de grave prejuízo; ii) a proporcionalidade, i.e. se visa a prossecução de um interesse público e se é adequado e necessário

A limitação de poderes justifica-se porque após a demissão, o Governo não deve poder condicionar a atuação do futuro Governo. O Governo de gestão não está limitado em função da natureza, forma ou conteúdo dos atos, podendo exercer as funções política, legislativa e administrativa

Após a sua demissão, o Governo deixa de estar na plenitude dos seus poderes, tendo competências limitadas, pois apenas pode praticar os «atos estritamente necessários para assegurar a gestão dos negócios públicos» (art 186.º, n.º 5). É o período do designado “Governo de gestão”.

O PR pode dissolver a Assembleia da República a todo o tempo com duas exceções: os últimos seis meses do seu mandato e os primeiros seis meses do mandato da própria Assembleia.

O PR é aquele pode decidir dissolver. Aliás, se mais ninguém quiser formar Governo, o PR fica com poucas hipóteses senão dissolver a Assembleia.

Nenhuma leva automaticamente à dissolução da Assembleia da República e à marcação de novas eleições. O PR ouve os representantes dos grupos parlamentares e pode convidar a formar Governo o líder de um outro (o do mesmo partido), com base na mesma composição da Assembleia.

No nosso sistema constitucional, a diferença entre uma moção de censura e uma moção de confiança é que a primeira para ser aprovada (melhor dizendo, para levar à demissão do governo) precisa de ser aprovada por maioria absoluta. A de confiança é aprovada por maioria simples.
