I did not imagine I would be lucky enough to be labelled a ‘misinformation pseudoscientist’ and part of the ‘pro censorship left’ by Republicans in the US House of Representatives Judiciary Committee, but I shall be adding this to my bio with pride

We hope to stimulate and provoke debate about free elections, election falsehoods, and the future of positive obligations in the Strasbourg Court.

We thread our arguments through the analytical prism of Bradshaw and others v. The United Kingdom. With this judgment being released this week, our arguments are extremely timely, in the event that this case is referred to the Grand Chamber and also for inevitable future cases which are to follow.

Katie Pentney and I make the normative case for the ECtHR to rethink its analytical approach to the right to free elections under Article 3 of Protocol 1 in cases involving disinformation and Foreign Information Manipulation and Interference (FIMI).

Kneecap terror case is 'pivotal' for free speech, experts say 'The more they come after Kneecap the louder they will get,' say the band's legal team after bail on terror charge.

Glad to be quoted in this headline and article.

We await to see what August 20 brings.

Well worth a read from @ethanshattock.bsky.social on the Kneecap case, the complexity of the ECtHR's freedom of expression jurisprudence and it's increasingly frequent invocation of Art 17 on the abuse of rights where expression is connected to banned groups:

Academic me: it’s deeply troubling to see animal misinformation go under the radar, people see ostensibly ‘cute’ videos and ignore the irresponsible and misleading nature of the video.

Non-academic me: Omg bunny, chonk, cute, like.

@ethanshattock.bsky.social notes that the recently approved code of conduct on disinformation matters because it codifies this as a systemic risk under the DSA. He does worry, however, about insufficient references to freedom of expression protections

Completely naive to think that this is practically achievable. If the funding isn’t there to go to existing conferences, how are people going to have the ability to ‘build’ their own?
