We hope to stimulate and provoke debate about free elections, election falsehoods, and the future of positive obligations in the Strasbourg Court.
We thread our arguments through the analytical prism of Bradshaw and others v. The United Kingdom. With this judgment being released this week, our arguments are extremely timely, in the event that this case is referred to the Grand Chamber and also for inevitable future cases which are to follow.
Katie Pentney and I make the normative case for the ECtHR to rethink its analytical approach to the right to free elections under Article 3 of Protocol 1 in cases involving disinformation and Foreign Information Manipulation and Interference (FIMI).
