The article addresses a similar subject matter as my ongoing PhD research @ucllaws.bsky.social . I argue that the CPTPP contains a mechanism that could help build up civil society involvement in climate decision-making in countries where such space has historically been constrained, and explain why.

With Festivus coming up, it's a good time to think about the US airing its grievances on the WTO's appeals process, which has led to a dispute settlement reform discussion. There have now been some interesting proposals on appeal/review as part of this discussion, which I comment on in this new post
This US proposal raised some questions for me, including:
- Is the US ready for all the rebalancing arbitrations that might take place?
- How will other Members react to this proposal?
- Will the Trump administration support this proposal?

The EU was taken to task again this week at the WTO over the deforestation regulation, with Brazil and others insisting that the EU notify the EUDR as a "quantitative restriction". The EU refused. The US said it wants an extension to enforcement date. They may get their wish.
1️⃣ The IEA and the OECD have just released their latest combined estimates of the fiscal cost and implicit value of government support for fossil fuels across 82 economies. That value dropped from USD 1.6 trillion in 2022 to USD 1.1 trillion in 2023, but remains above historical trends.

📝 ACCTS Chapter 7 dispute settlement on non-implementation/compliance:
- No 'sanctions' available in the sense of suspension of concessions
- Not entirely 'soft' either, with measures on personnel, suspension of cooperative activities, and what may be termed a 'shaming' mechanism?

The big thing in the FFS Chapter that stands out to me is that it does not apply to production subsidies for oil and natural gas “when granted in the form of tax revenue foregone”. Such forgone revenue constitutes the majority of the production-related support in the OECD Inventory.
That’s absolutely good spotting—that subpara also caught my eye and I was just wondering how much leeway that provides. Thanks for the helpful info! (For those interested, relevant here is Art. 4.5.5.)
Not used to think out loud but in the spirit of the new platform and the new ACCTS—now reading through the fossil fuel subsidies chapter and finding the Specific Exceptions clause intriguing. Is this subpara the first of its kind? Would appreciate signposts to possible precedents.
