It doesn't work like that. It would be up to a court to decide if the non-profit's use of a copyrighted work qualifies as fair use. Most non-profits would rather pay for a license upfront instead of risking a copyright infringement case.

You can't copyright the *design* of a font, so you could create your own clone font. However, the actual font files *are* protected by copyright, because they are software (yes, really) and software is obviously protected by copyright.
