This special issue marks the twentieth anniversary of the Civil Partnership Act 2004 (‘the CPA’) and the Gender Recognition Act 2004 (‘the GRA’). Passed by the Westminster Parliament within four months of each other, the CPA and the GRA represented a landmark moment for the rights of lesbian, gay, bisexual and trans (‘LGBT’) people in the United Kingdom. The laws permitted same-sex couples, for the first time in this jurisdiction, to access formal rights and recognition of their relationships [CPA] while also enabling trans individuals to amend their legal sex by way of a Gender Recognition Certificate (‘GRC’) [GRA]. The CPA and the GRA have had significant immediate, and long-term impacts, on the social, legal and political status of LGBT people across the UK, and their legacy has remained a source of continuing public debate since 2004.

The only way states can enforce sex policing in public spaces (like toilets) is by incentivising misogynistic, transphobic social surveillance. People will scrutinise, question, intrude on cis and trans women who do not conform to certain gender aesthetics. This is happening now. And it’s chilling.
