Notably Trump used the same provision to block oil leasing in waters near Florida & the Southeast US while campaigning for reelection in 2020 (those designations are due to expire in 2032). Other presidents have used the authority: Dwight Eisenhower, George H.W. Bush, Bill Clinton & Barack Obama.

Though presidents have modified predecessors’ orders withdrawing areas from oil leasing, courts have never validated a complete reversal — and until Trump, no president had even attempted one. (A federal district court turned back Donald Trump’s attempt to revoke Obama-era withdrawals in 2019.)

Unlike executive orders and regulations that can be easily repealed, Biden’s declaration is set to be rooted in an obscure 72-year-old provision of federal law that gives presidents wide discretion to withdraw US waters from leasing (without explicitly authorizing them to undo those designations).
