Big abortion win in PA today - the ban on Medicaid funding is unconstitutional!

AND there's a fundamental right to abortion!

We won!

(Though this Commonwealth Court opinion can be appealed - we'll see what our AG does.)

We had a last minute cancellation: does anyone with policy experience working in federal administrative agencies want to come talk to my HKS admin law seminar tomorrow (Friday 4/17) at 1pm ET about the role of policy experts in federal agencies?

Happy to do remote - DM me if interested!

Lady Whistledown…and the Legal Academy? - Legal Profession Maybell Romero, Gossip, 115 Geo. L. J. __ (forthcoming, 2026), available at SSRN (Feb. 1, 2026).Leah LitmanThere’s no one like Professor Maybell Romero in the legal academy (I say this, a la Violet Chachki, as a compliment, not a read). In a searing article from several years ago, Ruined, Romero used her own experiences with rape and sexual assault to critique how the law and legal profession describe survivors as “ruined,” “broken,” or “destroyed.” Then, in Shamed, Romero expanded the [...]

Whoever is in charge of scheduling oral arguments at SCOTUS has a tragic sense of humor.

Here’s a link to the oral argument for the birthright citizenship case which will start any minute now

This is not just a win, and not even just a win that will improve many people's lives. It is also proof of concept of a form of scholarship that Rachel pioneered. (Make sure to read the whole thread.)

Your support and amplification means so much to me, Edith! This win belongs to so many incredible advocates but I just feel so lucky to be with them as part of this journey!

True! Important correction! It’s just the cruel punishment provision now.

Your post reminded me of a Spanish saying “Nosotros estamos poniendo un granito de arena para un mundo mejor.” Effectively it means we all must contribute a little grain of sand in order for big change in the world to be possible.

Redeeming Justice Approximately three decades ago, two of us, Terrell Carter and Kempis Songster, were sentenced to life in prison without the possibility of parole. The U.S. Supreme Court has said that this sentence, ...

In its decision, the Court cites my amicus brief on behalf of UN experts (p. 34) and also relies on the conclusions of the UN Human Rights Committee (p. 31).

Today is one of those rare days as a lawyer and scholar when the law offers a glimmer of hope. Amazingly, today, the PA Supreme Court held that automatic life-without-parole sentences for 2nd degree murder, including felony murder, amount to cruel & unusual punishment under the PA Constitution.

most americans are clueless about how trump is ripping apart the future for them & next generations.

what the world knows/sees: the united states recklessly launched a war of aggression without one thought about harms to others (lives, economy, climate, etc). not. one. thought.
