If you were a Supreme Court judge, how would you decide Cheshire West Revisited? Observers form opinions about what they see, opinions informed by their own unique expertise and knowledge base (professional and personal).

New blog post

After observing the case in the Supreme Court reconsidering Cheshire West, seven different court observers reflect on how THEY would want law and practice changed in relation to Deprivation of Liberty Safeguards.

When open justice undermines public confidence: Scrutinising the Supreme Court Justice is not a cloistered virtue; she must be allowed to suffer the scrutiny and respectful, even though outspoken, comments of ordinary men

Open justice is supposed to enhance public trust + confidence in the justice system - but in this case it had the opposite effect.

What does the Supreme Court need to do differently to make sure COP observers have a better experience next time?

Observing the Judges in the Supreme Court referring to people as 'the demented' and 'old dears' felt extremely regressive, not to mention the discussion that some people with mental impairment have no liberty to be deprived of. What are your thoughts? 🧐

A Reference by the Attorney General of Northern Ireland of a devolution issue under paragraph 1(b) of Schedule 10 to the Northern Ireland Act 1998 - UK Supreme Court “Whether the Minister of Health has power to revise the Deprivation of Liberty Safeguards Code of Practice issued under s.288 of the Mental Capacity Act (Northern Ireland) 2016 (‘the 2016 Act’) so as ...

Very interesting upcoming case from Northern Ireland in UK Supreme Court - about whether a person could be taken to consent to what could otherwise be a 'deprivation of liberty' if it aligns with their wishes and feelings www.supremecourt.uk/cases/uksc-2...

New blog post!

Judge made 'best interests' decision that (previously public) hearing should be PRIVATE when observer turned up for the first time

She used the Civil Procedure Rules
