Upon arriving in Africa, Cap changes back to Billy and meets an American soldier. He and his fellows are really excited to meet the famous Billy Batson. Later, around the campfire, he answers all the same questions every GI overseas asks in old movies about what’s going on back in the USA: “ YES, THE EMPIRE STATE BUILDING IS STILL STANDING THE GIRLS ARE STILL PRETTY NO, THEY HAVEN'T STOPPED BIG LEAGUE BASEBALL! YES, JIVE IS STILL POPULAR! GOSH! IM RUNNING OUT OF BREATH!”

Billy makes a broadcast from the army camp: “..AND FOLKS, LET ME TELL YOU THESE SOLDIER BOYS OF OURS ARE GOING TO BRING VICTORY FOR AMERICA BEFORE YOU CAN SAY ADOLF SHICKELGRUBER! AS FOR THE BLACK PEARLS YOU HEARD ABOUT - CAPTAIN MARVEL IS ON THE JOB!” Meanwhile, IBAC tunes in on the scene with the black pearls. Delighted, the disembodied voice of Mister Mind communicates through IBAC’s belt buckle radio and tells him to take false orders to the army camp.

Chapter 2 of the Monster Society of Evil, “The Jungle Trap,” by Otto Binder & CC Beck. Mr Mind orders IBAC to hustle to Africa, via rocket. Following him there, Billy meets up with some US soldiers.

Captain Marvel picks up the false orders off the ground as IBAC jumps in a truck, intending to run him over. Instead, the truck explodes when it slams into Captain Marvel, and IBAC is launched through the air with a confused expression, still holding the steering wheel. Captain Marvel has been reading the orders and didn’t notice at all.

After badly bungling a mission to sneak onto the base and deliver false orders, IBAC gets into a fight with Cap. It goes poorly for him

It’s been amazing to see a number of creators choosing to use the Captain Marvel moniker in the last year or so alone.

A lot of factual inaccuracies, but happy to see that the current main version now being called Captain Marvel is being covered by comic book news sites.

This is the last one that I did!

Getting the itch to do another one, though.

Two, if there's a story element on the cover, such as saying his name on a speech bubble, it does not infringe on the Captain Marvel trademark.

What they can't do is use the Captain Marvel term on the cover or as the title of the comic as Marvel Comics owns the Captain Marvel trademark.

There's only two exceptions.

One, DC can get Marvel's permission, which would likely involve a deal, such as when they did it for Power of Shazam! #1.

Let's start with a simple one.

Can DC Comics call him Captain Marvel or otherwise use the moniker?

Yes, they can.

They have always been able to since first licensed and published the character in 1972 (and later purchased outright), since it is part of the character's copyright.
