Captain Marvel picks up the false orders off the ground as IBAC jumps in a truck, intending to run him over. Instead, the truck explodes when it slams into Captain Marvel, and IBAC is launched through the air with a confused expression, still holding the steering wheel. Two, if there's a story element on the cover, such as saying his name on a speech bubble, it does not infringe on the Captain Marvel trademark.

What they can't do is use the Captain Marvel term on the cover or as the title of the comic as Marvel Comics owns the Captain Marvel trademark.

There's only two exceptions.

One, DC can get Marvel's permission, which would likely involve a deal, such as when they did it for Power of Shazam! #1.

Let's start with a simple one.

Can DC Comics call him Captain Marvel or otherwise use the moniker?

Yes, they can.

They have always been able to since first licensed and published the character in 1972 (and later purchased outright), since it is part of the character's copyright.
