Le droit d’accès à ses origines personnelles constitue un droit fondamental, consacré par différents textes internationaux, en particulier la Convention européenne des droits de l’homme et des libertés fondamentales, en son article 8 ([1]), et la Convention internationale des droits de l’enfant de l’Assemblée générale des Nations Unies, dont l’article 7 reconnaît à l’enfant, « dans la mesure du possible, le droit de connaître ses parents ». La présente proposition de loi vise à garantir le droit d’accès à ses origines pour toute personne majeure, par la légalisation encadrée des tests génétiques à visée généalogique. La France est aujourd’hui, au sein de l’Union européenne, le seul pays avec la Pologne à pénaliser l’usage des tests génétiques à visée généalogique. L’article 16‑10 du code civil dispose en son premier alinéa que « L’examen des caractéristiques génétiques constitutionnelles d’une personne ne peut être entrepris qu’à des fins médicales ou de recherche scientifique ». En l’état actuel du droit, l’article 226‑28‑1 du code pénal punit le recours à de tels tests d’une amende de 3 750 euros, tandis que l’article 226‑28 sanctionne leur commercialisation d’une peine d’un an d’emprisonnement et de 15 000 euros d’amende. En pratique, les usagers ne sont pas poursuivis et les sanctions restent inappliquées. De fait, les tests sont facilement accessibles dans les pays voisins. Ainsi, 200 000 Français y auraient recours chaque année et l’on estime qu’environ 1,5 million de Français ont déjà effectué un test à des fins généalogiques. Ces chiffres illustrent que de très nombreux Français revendiquent le droit de connaître leurs origines, et que ces tests répondent à un besoin psychologique et à une quête identitaire légitime. Ils sont particulièrement importants pour les personnes nées sous X, issues d’une procréation médicalement assistée avec don, d’une adoption internationale ou pour celles qui ne connaissent tout simplement pas un pan de leur histoire.
