Why I don't expect liberal democracy to go away any time soon: My article on the resilience of liberal democracy, published in @jeppjournal.bsky.social.

Perfectly timed to the day after Orbáns defeat and a small spike in "democracy-optimism".

There are, I argue, good reasons for such optimism.

First, EU law litigation is not only driven by resourceful business and trade associations, but also by a surprising abundance of resourceless individuals and a paucity of labor unions and advocacy groups. Second, individuals, labor unions, and trade associations are most effective in influencing the ECJ, but in counterintuitive ways: whereas labor unions and individuals prompt liberalising rulings that restrict national autonomy, trade associations prompt protectionist rulings. Finally, individuals and advocacy groups are better able to attract attention and shape downstream legal debates via litigation than businesses and trade associations. The “haves” are certainly protagonists of EU law litigation, but they are neither the sole nor the most effective protagonists.

Beyond a comprehensive survey of what we know/still don't know about EU law litigation, we have three overarching findings that complement/contextualize our 2025 @bjpols.bsky.social article w/ @louisabo.bsky.social on why individual "have nots" come out ahead at the CJEU (see: cup.org/4oWD6ZT)

How Israel Used the War in Gaza to Accelerate Settlements in the West Bank The Netanyahu government is pushing expansionist policies, while America looks the other way.

The male genius myth is harmful to everyone. As a Nordic female academic, I was shocked by the culture when I was a visiting scholar at Harvard. It is so much better to be a female professor in the Nordics!

Precarious positions? Gender, quotas and the politics of (re)appointment How does judicial constraints impact the decision-making of female and male judges, and female judges appointed under a quota? I argue that the gender-based selection bias female judges face during t...

Sharing my latest working paper where I investigate the effect of being appointed under a gender quota on judicial behaviour. Are female judges appointed under a quota in more precarious positions, and as a result are they more loyal towards their appointing authority? Find out: tinyurl.com/548n33kn

“Is the @eucourtofjustice.bsky.social a social court protecting the ‘have nots’ or an economic court beholden to the ‘haves’?” @silje-hermansen.bsky.social, @louisabo.bsky.social & I have an answer on @verfassungsblog.de. This holiday season, our analysis give us reason to be biased for hope:

quote: “Across thousands of cases argued before the Court, individuals who claim individual rights win systematically more often than more resourceful clients – including businesses that tend to show up with better lawyers.”

Is the ECJ a plaything of the powerful — or a protector of the weak?

New litigation data suggests a clear answer.

TOMMASO PAVONE, SILJE SYNNØVE LYDER HERMANSEN & LOUISA BOULAZIZ show how the Court levels the odds for individual rights claimants.
