The entire basis of the deliberative process privilege which normally protects predecisional material is that it might chill the writer, and an AI by definition can't suffer a chilling effect because it doesn't and can't care about what it's output is
Hasn't been litigated, but I believe yes and I've been waiting for a good test case to prove as much if somebody can fund it
