I actually think there is a broader point to be made about lots of judges evaluating claims for injunctive relief against the police. They have never felt the endemic, oppressive force of policing; they find it hard to believe that systemic solutions are necessary/worth the squeeze.

I think it’s a combo of dusty is the real deal + great team chemistry + Roddy et al who stuck it out after the 8 win season and helped build the culture with the NIL newbies.

as a former civil rights litigator, 100% agree.
Sometimes in more powerful ways than by just putting it into the universe through other means. Again, even if you cant ultimately get what you want.
IOW, courts/litigation are a tool/device that goes far beyond court victories themselves; losses often do as much as wins.
Of course. The way I get my students to look at it is that a lot of litigation is brought without ever being able to achieve/obtain the true relief sought. Such relief is more likely to come through other branches, but putting it into the courts puts it into the public conversation.

I've been thinking about this as well. I talk about this phenomenon in my seminar (and it somewhat relates to points i've seen @beaubaumann.bsky.social making on here lately) about how litigation lends a veneer of legitimacy to viewpoints and institutions as arbiters of those viewpoints.
Such a powerful set of observations by @jcschwartzprof.bsky.social, including that court opinions and public commentary re: suing government officials when they violate the Constitution often focus on the reasons not to sue, and not the benefits that civil rights litigation can bring.
True story: I ran into bill self in a chipotle this fall when I was wearing a Michigan beanie. He called me on it.
