Virginia does not do show cause in that way often. Only when I had cases in CA did I have to deal with those motions. I must say the civil procedure of Virginia is way better than federal court or state courts in CA which are too cumbersome processes. Just get to the merits and skip wasteful motions

To be clear I think the judge ruling was technically fine. Virginia has a tradition of deciding cases on the merits, though, so there is a chance of reversal if the VA Supreme Court decides it wants to take the case and they find there was a “good cause” exception for missing the deadline.

Online attorney opinions can be complicated usually but not here. Missing that deadline to respond is per se malpractice. I litigated against the plaintiffs attorney. He is excellent. This is a terrible result that will hopefully be reversed but zoning changes delayed are denied. Horrible.
